Welcome to FlyEpic. This Privacy Policy describes the privacy practices of FlyEpic, Inc. (“FlyEpic,” “we,” “us,” or “our”) related to your use of our website at flyepic.aero, our social media channels, and other websites we own or operate (collectively, the “Site”), as well as your interactions with FlyEpic in any manner, including your inquiries about and participation in our fractional aircraft ownership and membership programs (collectively, our “Services”). This Privacy Policy is governed by our Terms & Conditions. BY USING THIS SITE OR SUBMITTING PERSONAL INFORMATION TO US, YOU AGREE TO THIS PRIVACY POLICY. If you do not agree, please do not use our Site or submit Personal Information to us.

FlyEpic is headquartered in Bend, Oregon, and markets and offers its Services to customers in the United States. If you have questions about our privacy practices, want to exercise a privacy right, or would like to make a complaint, please contact us at info@flyepic.aero.

Definition of “Personal Information”

As used in this Privacy Policy, “Personal Information” means any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. We generally describe Personal Information as falling within categories, for example:

  • Identifiers (e.g., name, email address, phone number, mailing address, username).
  • Commercial information (e.g., inquiries, products or programs of interest, transaction and membership history).
  • Financial information you provide to qualify for or participate in our programs (e.g., information relevant to eligibility for the EpicIntro 25 Card or a fractional ownership share).
  • Internet and network activity (e.g., interactions with our Site, emails, and ads).
  • Geolocation data (generalized location derived from your device or IP address).
  • Professional or business information (e.g., company name, title, and business contact details).
  • Sensitive information, only if you voluntarily provide it.

Not all information about a person is Personal Information. Information that is publicly available, aggregated, or deidentified is often exempt from privacy laws.

Collection and Use of Personal Information

We collect Personal Information when you visit the Site, submit a contact or inquiry form, request information about our programs, sign up for or engage with our emails, attend our events, or otherwise communicate with us. We collect and use your Personal Information with your consent as informed by this Privacy Policy, where we have a legitimate interest, or as authorized or required by law. Over the last 12 months, FlyEpic has collected and used Personal Information as follows:

  • Website Inquiries and Contact Forms. When you submit an inquiry or contact form, we collect your name, email address, phone number, location, and any details you choose to share about your interest in private air travel or our programs. We use this to respond to you, qualify your interest, schedule conversations, and follow up.
  • Program Qualification. If you express interest in the EpicIntro 25 Card, a fractional ownership share, or another program, we may collect commercial and financial information relevant to evaluating your eligibility and administering your participation. We collect this with your consent and use it only for those purposes.
  • Email and Marketing Communications. We use a customer relationship management (CRM) and email marketing platform to manage our customer relationships, host forms, and send marketing and informational emails. When you engage with our emails, we may collect engagement data such as opens and clicks. You can unsubscribe from marketing emails at any time using the link in any email.
  • Business and B2B Contacts. If you contact us on behalf of a business, or we engage with you in a business capacity, we collect your name, company, role, and business contact information to evaluate and manage the relationship.
  • Events and Brand Activations. We host and participate in events and activations (for example, at ski resorts, clubs, marinas, private clubs, and charity events). If you provide your information at one of these, we use it to follow up and share information you request.
  • Call Recording. If you contact us by phone, we may record calls for quality, training, or service purposes where permitted by law. You will be notified, and by staying on the line you consent to the recording. If you do not consent, you may end the call.
  • Social Media. If you interact with FlyEpic on social media, we collect your username and any information you choose to share, and we use it to respond to you and share information about our company and programs.
  • Site Activity, Cookies, and Analytics. Like most commercial websites, our Site uses cookies and related technologies to understand how visitors use the Site and to support analytics and advertising. We use them to collect technical data such as IP address, device and browser information, generalized geolocation, log data, and unique identifiers. You can adjust your browser or device settings, or use the cookie controls on our Site, to block or limit cookies, though some Site features may not work as a result.

We may also use Personal Information to (i) monitor compliance with our Terms & Conditions; (ii) protect the rights, property, and safety of consumers, FlyEpic, and others; (iii) identify, contact, or bring legal action where we believe it necessary; (iv) comply with law, legal process, or court order; or (v) fulfill any other purpose to which you consent. We will not collect additional categories of Personal Information, or use it for materially different purposes, without notice and consent as required by law.

Children’s Privacy

The Site and our Services are designed for adults. We do not knowingly collect Personal Information from anyone under the age of 16. If we learn we have collected information from someone under 16, we will delete it. If you believe we may have done so, please notify us at info@flyepic.aero.

Disclosure to Third Parties

FlyEpic relies on service providers and other third parties to operate our Site and provide our Services. We disclose Personal Information only as described here, with your permission, or as required by law. Your consent to this Privacy Policy is also your consent to these third parties accessing and processing your Personal Information as described. We may disclose Personal Information to:

  • Service Providers and Processors. Providers that help us operate our Site and Services, such as customer relationship management (CRM), email, data hosting, IT, analytics, advertising, and payment providers. We require service providers to protect Personal Information and prohibit them from using it for their own purposes.
  • Advertising and Analytics Partners. Advertising and analytics providers that help us measure our marketing and deliver ads, which may involve the use of cookies and similar technologies on our Site.
  • Our Suppliers. Suppliers and partners, including our aircraft manufacturer, where needed to evaluate eligibility, provide aircraft and operational support, and deliver the Services you request.
  • Professional Advisors. Lawyers, accountants, auditors, and similar advisors, as needed.
  • Law Enforcement and Government Agencies, as permitted or required by law.
  • Business Transfers and Legal Claims. In connection with a merger, acquisition, financing, or sale of assets, to comply with law or court order, to prevent fraud, or to exercise or defend legal claims.
  • Aggregated and Deidentified Information. We may share aggregated, anonymized, or deidentified information with third parties for any purpose, without restriction

Retention of Personal Information

We retain Personal Information as needed to fulfill the purposes for which it was collected and for our internal business purposes. Inquiry and marketing data is retained until it is no longer pertinent to our business or you ask us to delete it, whichever occurs first. Cookie data is retained for as little as a few minutes or as long as 24 months. We may retain data for longer periods where required by law or court order, or where doing so is critical to our business.

Data Security

FlyEpic maintains reasonable administrative, technical, and physical safeguards designed to protect Personal Information from accidental loss and unauthorized access, use, alteration, and disclosure. Personal Information is stored on secure servers located in the United States. No method of transmission over the Internet is completely secure, and any submission is at your own risk. You are responsible for keeping your account and login information confidential.

Privacy Controls

You can directly control how we collect and use your Personal Information:

  • Your Account. You can access, correct, or update certain Personal Information by contacting us or, where available, by logging into your account and saving your changes.
  • Our Emails. We will send you email messages related to programs or services you request and marketing messages you have signed up to receive. You can unsubscribe from our emails at any time by clicking the link at the bottom of any FlyEpic email. If you opt out of marketing emails, we may still send you informational messages related to services you have requested.
  • Text Alerts. If you provide us with your wireless number and consent to receive texts from us, we will send you service or appointment alerts and other messages. We will only send you marketing text messages if you opt in to receive them. The number of texts you receive will depend on the information and services you request from us. You can unsubscribe by replying STOP or UNSUBSCRIBE to any of these text messages. Messaging and data charges may apply to any text message you receive or send. Please contact your wireless carrier if you have questions about messaging or data charges.
  • Do Not Track. Do Not Track signals are signals sent through a browser informing us that you do not want to be tracked. Currently, our systems do not recognize browser “do-not-track” requests.
  • Your Device Settings. You can control the data we collect through cookies and related technologies by adjusting your device settings.
  • Block Location Tracking. You can stop all collection of information by an app by uninstalling it. You can also reset your device Ad ID at any time through your device settings, which is designed to allow you to limit the use of information collected about you. You can stop all collection of precise location data through an app by uninstalling it or withdrawing your consent through your device settings.
  • Privacy Requests. Section 8 lists the privacy rights applicable to the markets we serve. To exercise your rights under applicable privacy laws, or if you want to express concerns, revoke your consent, lodge a complaint, or request information, please submit a privacy request to info@flyepic.aero. We can only assist with or fulfill a privacy request when we have sufficient information to verify that the requester is the person, or an authorized representative of the person, about whom we have collected Personal Information, and to properly understand, evaluate, and respond to the request. We do not charge a fee to process or respond to a verifiable request unless we have legal grounds to do so. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request. We endeavor to respond to privacy requests in accordance with the requirements of the law applicable to your jurisdiction. If we do not fulfill your request within the legally required timeline, you can appeal our response by contacting info@flyepic.aero.

Privacy Rights

Depending on where you reside, you may be entitled to additional controls over your Personal Information. Please note that we market and offer our Services to customers in the United States and, as such, this section provides privacy notices to consumers in that market only. If you reside elsewhere, please do not submit your Personal Information to us.

a. United States Privacy Rights

In the United States, consumer privacy is governed by federal privacy laws covering specific industries or data uses and state privacy laws providing general consumer privacy rights. For example, California, Colorado, Connecticut, Oregon, Texas, Utah, Virginia, and other states require companies to inform consumers about their privacy rights and provide a method to exercise those rights.

PLEASE NOTE THAT SOME U.S. PRIVACY LAWS DO NOT APPLY TO FLYEPIC OR OUR PRODUCTS OR SERVICES. In those cases, the notices in this section are provided as a courtesy only. We will respond to and fulfill your request to the extent required by applicable law.

Depending on the state in which you live, you may be entitled to some or all of the following privacy rights:

  • Right to Correct. You have the right to correct your Personal Information if it is inaccurate. You can alert FlyEpic that your information is incorrect so we can update it.
  • Right to Deletion. You may request that we delete the Personal Information that we hold about you, with exceptions. If you request deletion, we may permanently delete, deidentify, or aggregate the Personal Information.
  • Right to Access. You can request that we confirm whether we have collected Personal Information about you and provide you with access to that Personal Information in a portable and readily usable format. We may be prohibited by law from disclosing certain pieces of Personal Information, and we may be limited in the number or frequency of requests we must fulfill.
  • Sale or Sharing; Targeted Advertising. Some states entitle consumers to opt out of the sale or sharing of Personal Information or targeted advertising practices. FlyEpic does not sell your Personal Information for money. However, our use of analytics and advertising cookies may be considered “sharing” for cross-context behavioral advertising, or a “sale,” under some state laws. You may opt out using the cookie controls on our Site.
  • Limited Use and Disclosure of Sensitive Information. FlyEpic does not intend to collect any sensitive information. If you choose to submit sensitive information to us, we will not share it with third parties for any purpose other than providing you with the services you request.
  • No Profiling. FlyEpic does not use any form of automated profiling that produces legal or similarly significant effects.
  • Right to Disclosure. You may request that we disclose information to you about our collection and use of your Personal Information, such as: (i) the categories of Personal Information we have collected about you; (ii) the categories of sources for that Personal Information; (iii) our business purpose for collecting, using, processing, sharing, or selling it, as applicable; (iv) the categories of third parties with whom we share it; and (v) if we sold or shared your Personal Information, two separate lists stating sales/sharing and disclosures for a business purpose. Certain laws may limit the number or frequency of requests we must fulfill.
  • Right to Disclosure of Marketing Information. California’s Shine the Light Act (Civil Code sections 1798.83–1798.84) entitles California residents to request certain disclosures regarding Personal Information sharing with affiliates and/or third parties for marketing purposes.
  • Right to Nondiscrimination. FlyEpic will not discriminate against you for exercising your privacy rights. We will not: (i) deny you goods or services; (ii) charge you different prices or rates; (iii) provide you a different level or quality of goods or services; (iv) retaliate against you; or (v) suggest that you may receive a different price, rate, level, or quality of goods or services because you exercised a right under applicable privacy laws.

b. California Residents

If you are a California resident, this section serves as our notice at collection. In the last 12 months, we have collected the following categories of Personal Information: identifiers (such as name, email address, phone number, mailing address, and IP address); commercial information (such as programs of interest and inquiry or membership history); financial information you provide to qualify for or participate in a program; internet and network activity (such as your interactions with our Site, emails, and ads); generalized geolocation; professional or business information; and inferences drawn from the above. We collect this information directly from you, automatically through your use of the Site, and from our service providers and advertising and analytics partners. We use it for the purposes described in Section 2, and we disclose it to the categories of recipients described in Section 4.

We do not intend to collect sensitive Personal Information except where you voluntarily provide it, and we do not use it to infer characteristics about you. California residents have the rights described in Section 8(a) above, including the rights to know, access, correct, delete, and opt out of the sale or sharing of Personal Information, as well as the right to be free from discrimination for exercising them.

To exercise any of these rights, contact us at info@flyepic.aero, or submit a request as described in Section 7. You may use an authorized agent, in which case we may require proof of authorization and verification of your identity. You may appeal a denial by contacting us at the same address.

c. Other States

Residents of other states with comprehensive privacy laws may exercise the applicable rights listed in Section 8(a) by contacting info@flyepic.aero. We will verify and respond as required by your state’s law, including any right to appeal.

Owned and Operated in the United States

FlyEpic is headquartered in Bend, Oregon, and operates in the United States, including locations in California (such as San Carlos and Santa Monica). We market and offer our Services to customers in the United States. If you access the Site from outside the United States, you agree that your Personal Information will be transferred to, processed, stored, and used in the United States, where data protection laws may differ from those in your country, and where information may be accessed by government authorities under U.S. law.
